With our offices situated and operating out of Roodepoort, with service offerings focused on Pretoria, Johannesburg, Sasolburg, Vereeniging, Meyerton and other surrounds within Gauteng, we have applied a new strategy towards debt collection without having to appoint correspondents outside of Gauteng.
Although we have managed to complete successful collections in remote areas of Kwa-Zulu Natal, Free State and even the Northern Cape on demand of certain clients, we find that these can be costly ventures.

Soft Debt Collection
Soft collections are a term used to describe the collection of bad debt by means other than legal action. This process is implemented before legal action is instituted as a last effort to collect monies due quicker and at a lower cost.
The ADM Approach#

- A campaign agreed process is agreed upon with our client or we make use of our tried and tested Module of effectively running of collection campaign such as:
- Debit Order Campaign
- Bulk SMS Campaign
- Bulk Email Campaign
- Telephonic Campaign
- Once contact is made with debtor, the spin rates are determined the selected strategy.
- On average debtors are contacted 6 times a month
- SMS reminders are sent out and are averaged at 4 SMS’s per month, per debtor.

Pre-Legal Debt Collection
Pre-legal debt collection services focus on recovering outstanding debts through non-legal methods before a lawsuit is filed. This includes actions like sending demand letters, making phone calls, and negotiating repayment plans with debtors. In South Africa, this phase is often referred to as "pre-legal" or "amicable" debt collection.
The ADM Approach#
This process will normally take place if the Soft Debt Collection process is not successful.
This process will mainly be the following structure:
- Personal Visits
- Signing of AOD’s and Legal Notices
- Delivering Legal Notices
- Debtor Detail Verification

Legal Debt Collection
Legal Debt collection is when an attorney, a person who is an agent of an attorney or a registered debt collector collects, on behalf of the credit provider, an outstanding amount plus lawful interest, admin costs and collection fees, which by law is capped to certain amounts.
The ADM Approach#
The Legal Debt Collection route is used as a final tool to optimize collections and is not a goal in itself, since this process can become expensive.
- The process will be as follow:
- Accounts allocated to the ADM Legal according to client specification or ADM strategy.
- Accounts will be allocated to a Magisterial District / jurisdiction and to an attorney contracted to ADM to ensure processes are granted and issues in the Correct Districts.
- Attorney may employ soft collection strategy initially if legal action is required and if to no avail may be permitted to proceed with legal action.
- ADM templates approved by legal experts and the client are used in the legal process.
- Summons Process
- Section 129 notices are sent.
- Summons is issued in correct jurisdiction and served.
- This procedure might entail the use of correspondents in areas outside the Attorneys jurisdiction, the costs of which the Client will be liable for.
- Judgment is obtained.
- Section 65A enquiry is held and payment order obtained.
- Attorney continues with collection process.
- Trust money is receipted and paid over to ADM.
- ADM accounts to the client at agreed intervals.
- Other legal process that can/will be followed.
- Section 58 Emolument Attachment Order
- This procedure is followed when the debtor is employed and earning a salary.

- Drawing up of and granting of Judgment and Emoluments Attachment Orders
KAPP Attorneys are the appointed attorneys of ADM Credit Consultants, and are registered as practicing attorneys with the Law Society which regulates the ethical code of conduct for the legal profession in South Africa.

Tracing Services

Debtor Tracing:
- Locating individuals who owe money, often for debt collection purposes.

ITC Listing
An ITC listing in South Africa refers to a record of negative credit information (default listings, judgments, etc.) stored with the ITC Credit Bureau, a major credit bureau. This information can affect an individual or company's ability to obtain credit, loans, or other financial products.
The ADM Approach#
Default Listing:
- This occurs when a debtor fails to pay a debt after receiving a final demand letter and a 28-day waiting period.
- This is entered on a credit profile if a court grants judgment against an individual or company.
- This can include late payment records or other adverse information that impacts creditworthiness.

As well as promise to pay arrangements, i.e. all undefended collections matters, defended collection matters, opposing and rescission of administration orders and rescission applications as well as warrant of execution against individuals and companies.
